District Court Judge Gary Sharpe, in Tuesday's dismissal, based his decision around an affidavit Quinones submitted in connection with a fellow officer's separate racial discrimination complaint, in which he provided an account of a conversation he had with the police chief involving alleged racist remarks.Lawyers for the City of Binghamton had argued to dismiss Quinones' lawsuit, saying the complaint failed to allege that any discrimination or retaliation were products of a policy, custom, or practice of the city. The lawsuit by Lt. Alan Quinones was filed Nov. 25, 2019 in Binghamton's federal courthouse, arguing that he'd been "consistently and systematically the victim of discriminatory treatment based on his natural origin" since joining the Binghamton Police Department in March 2008 as a patrolman.
